• Note (General): type:text; 本年度は、コルネリア・フィスマン（1961-2010）のメディア理論に集中的に取り組んだ。フィスマンは、ドイツでメディア論を立ち上げ牽引したフリードリヒ・キットラーの世代に続く、第二世代のメディア論者である。先駆者キットラーが切り開いたテクニカルなメディアの理論ではなく、法のメディア論が彼女のメインテーマである。フィスマンの主著『書類——メディア技術と法』（2000年）は、邦訳はまだないが、ドイツ・メディア論のなかにあって異色の名著である。フィスマンは書類を「法が働く基盤」と呼んでいる。そのような視点から、古代から現代にいたるまでの書類の歴史を綴り、法制史の基盤となるメディアの歴史を考察したのである。フィスマンにはそのほか、競技＝論争（Agon）と演劇を裁判の二つの本質要素として把握し、それらを実現する司法のメディア史を古代から現代までたどった労作『司法のメディア』（2011年）がある。 本年度の研究は上記の二作をはじめ、フィスマンの著作を熟読することからはじめた。くわえて、フィスマンと近い研究者トーマス・ヴァイティン、フィスマンと同じく法のメディア論を展開するミヒャエル・ニーハウスやフリードリヒ・バルケの著作を読み込んだ。 以上のような基礎研究にもとづき、本年度の研究の成果として、論文「法のメディア論——コルネリア・フィスマンとともにゲーテ『若きヴェルターの悩み』を読む」の原稿を執筆した（2021年度に刊行を予定）。本論文は、フィスマンの理論を援用することにより、『若きヴェルターの悩み』を一八世紀ドイツの司法制度の記録として読むことを提案するものである。『ヴェルター』は、法の残酷や不平等を批判する一八世紀の啓蒙主義的感傷主義（Empfindlichkeit）による法改革の流れのなかにある。そして同時に、来るべき一八〇〇年頃の司法改革、すなわち書類中心の法制度から、直接的・公共的な声の原理へのメディア転換を先取りしている。 I worked on the media studies of Cornelia Vismann (1961-2010) intensively this year. Vismann is a theorist of German media studies who belongs to the generation after Friedrich Kittler. While Kittler, the pioneer of German media studies, was engaged in research into the history of media technologies, Vismann founded media of the law as a new field for media studies. Vismann's famous book, Files: Law and Media Technology (2000), is a unique masterpiece in German media studies, although it hasn't yet been translated into Japanese. Vismann calls files "the foundation on which the law works." From that perspective, she wrote a history of files from ancient times to the present; in this she examined the history of the media, which is the basis of legal history. In her work "Judicial Media" (2011), which traces the history of judicial media, Vismann argued that competition (Agon) and theater are the two essential elements of a trial. I began my research by reading Vismann's writings, including the above two works. In addition, I read works of Thomas Weitin, Michael Niehaus, and Friedrich Balke, who, like Vismann, have developed the media theory of law. Based on the above basic research, I wrote a paper titled "Media Studies of Law: Reading Goethe's The Sorrows of Young Werther with Cornelia Vismann" (scheduled to be published in 2021). This paper proposes that, by using Vismann's theory, The Sorrows of Young Werther can be read as a record of the German judicial system of the 18th century. Werther makes the case for legal reform in the spirit of Enlightenment sentimentalism of the 18th century, which criticizes the cruelty and inequality of the law. At the same time, it anticipates the coming 1800 judicial reform, that is, the media shift from a document-centered legal system to one based on the principle of voice, which is closely connected with directness and publicity.
