• Note (General): type:text; 本研究では、刑事立法評価を論じた近時の諸見解を概観し、さらに、個々の刑事立法に対する刑事立法評価がどのような形で行われてきたか（あるいは、どのような議論が欠落していたか）を概観した。 これによれば、立法評価枠組がどのようなものであるべきかにつき、2つの対立点あるいは整理すべき点があることが明らかになった。そのひとつは立法評価枠組の構造にかかるものであり、他のひとつは立法評価基準の調達方法にかかるものである。 前者については、刑事立法評価を憲法学の知見によって語り尽くそうとする 1段階構造を志向する見解と、憲法額の知見によって語られるべきフェーズ（第1のレベル）と刑法学の知見が機能するフェーズ（第2のレベル）を分けて論ずる2段階構造を志向する見解がある。 また、後者については、憲法学に評価基準を求めるか、刑法学に評価基準を求めるかという問題がある。 本研究では前者について2段階構造を採るべきことを前提に、後者については、第1のレベルでは憲法学に、第2のレベルでは刑法学に、評価基準が求められるべきことを明らかにした。 This study reviews the various recent opinions discussing criminal legislative evaluation, and further reviews how evaluations of individual bills have been conducted (or what discussions have been lacking). It revealed that there are two points that need to be sorted out as to what a legislative evaluation framework should look like. One concerns the structure of the legislative evaluation framework, and the other concerns the method of procuring legislative evaluation criteria. With regard to the former, there are two views: one is oriented toward a one-stage structure in which the evaluation of criminal legislation is to be told entirely by the findings of constitutional law, and the other is oriented toward a two-stage structure in which the phase to be told by the findings of constitutional law (the first level) and the phase in which the findings of criminal law function (the second level) are to be discussed separately. Regarding the latter, there is the issue of whether to seek evaluation criteria in constitutional law or in criminal law. This study assumes that a two-level structure should be adopted for the former, and clarifies that for the latter, evaluation criteria should be sought in constitutional law at the first level and in criminal law at the second level.
