• Note (General): 出版タイプ： VoR; type:text; 民事執行は、国家権力の直接的行使によって私人の権利実現を図るものである。そのため、長年にわたり、属地主義の原則（Territorialitaetsprinzip）が妥当すると説かれてきた。また、渉外民事事件においては、「手続は法廷地法による」の原則（Grundsatz der lex fori）が妥当すると説かれている。しかし、たとえば、外国において債権の差押転付命令等によって金銭債権の弁済がなされた場合に、日本でこの執行行為が認められないとすると、第三債務者が二重弁済を強いられる場合が生じる。この問題は、わが国ではほとんど議論がなされていなかったが、ドイツでは学説・判例において議論の蓄積がある。そこで、主に金銭債権執行を念頭において、ドイツでの議論を参考に外国執行行為の承認を認める枠組みを検討するのが本課題である。 ドイツでは、外国執行行為の承認に外国判決の承認に関する規定（ドイツ民事訴訟法328条）の適用はないとするのが、通説・判例の立場であるが、近時は民事訴訟法328条の一部類推を認める立場も有力化している。 日本では、最判令和3年5月25日民集75巻6号2935頁が、外国で懲罰的損害賠償を命ずる判決につき、当該外国で債権差押によって弁済充当がなされた場合に、わが国ではどの範囲で債務の消滅が認められるのかという形で問題となった。最高裁は、懲罰的損害賠償を命ずる部分を除いた債権について外国執行行為による弁済充当を認めたが、その根拠を示していない。他方、学説では、外国判決承認規定（民事訴訟法118条）の類推を認める立場が棚得られていたが、議論そのものは活発とは言えない状況にあった。 この点、一定の要件の下で外国執行行為を承認すべきである。すなわち、執行行為が属地性を有するとしても、執行項の効果それ自体の承認を否定することまで厳格にとらえる必要はないし、二重弁済の危険を回避する必要性があるからである。そこで、民事訴訟法118条1号（外国執行裁判所が国際執行管轄を有すること）と3号（外国執行行為が公序に反しないこと）の要件の下で、外国執行行為を承認すべきである。 Civil execution is a direct exercise of state power to realize rights. For this reason, the principle of territoriality has long been applied. And, in international civil procedure, the principle of lex fori is also to be applied. However, for example, when a monetary claim has been paid in a foreign country by a court order of seizure and transfer of claim, but this foreign execution act is not recognized in Japan, the third debtor may be forced to pay twice. In Japan, there has been little discussion of this issue, but in Germany, there is an accumulation of discussion in academic theory and judicial precedents. This task is to examine a framework for recognizing foreign acts of execution with reference to discussions in Germany. In Germany, the prevailing theory and precedents are that the provision regarding recognition of foreign judgments (Article 328 of the German Code of Civil Procedure) does not apply to the recognition of foreign acts of execution. However, recently, the position that a partial analogy to Section 328 of the Code of Civil Procedure would be applied has become more and more popular. In Japan, the Highest Court on May 25, 2021(Minshu Vol. 75, No. 6, p. 2935) held the extinguish of the debt by foreign execution with respect to claims excluding the part of punitive damages, but it has not mentioned the reason why the foreign execution act will be recognized in Japan. Some scholars have mentioned that the foreign execution act will be recognized under the analogy of the provision for the foreign judgment recognition (Article 118 of the Code of Civil Procedure), but the academic debate itself was not so active. In my opinion, foreign execution acts should be recognized under certain requirements. In other words, even if the execution act has territoriality, there is no need to deny the effect of the foreign execution act, and there is a need to avoid the risk of double repayment. Therefore, under the requirements of Article 118 No.1 (foreign execution court has international execution jurisdiction) and Nr.3 (foreign execution act does not offend public order) of the Code of Civil Procedure, the act of foreign execution should be recognized in Japan.
