• Note (General): type:text; 1930年代の『国家学会雑誌』、『法学協会雑誌』、第二次大戦前後の尾高朝雄の諸著作を分析した。戦前の日本の法学会では、ハンス・ケルゼンの純粋法学を含め実定法の諸理論が受容とほぼ同時に激しく批判されていた。その代わりに法の政治的理論ないしは社会学的理論が益々探求され、受け入れられていった。ケルゼンの純粋法学のいわゆる破綻という批判の大半は誤解ないしは無理解にもとづくが、それは当時の現実における自由主義とリベラルな法治国家の破綻、危機ないしは行き詰まりと重ね合わせて議論された。なぜならば純粋法学は、自由主義と法治国家の普遍性に理論的な基礎を与えるための最新かつもっとも洗練されたプロジェクトと考えられたからである。 尾高朝雄の諸著作はケルゼンの法学理論に対する社会学的現象学的批判として理解できる。尾高によれば実定的法秩序はそれ自体の内部では説明も再生産もできないものであり、常にその外部に土台を必要とする。彼はこの実定的法秩序の外部にあるなにかを現象学の補助により探求したと信じた。これが彼の社会学的国家理論の出発点であった。ここで問題になるのは実定法秩序（法システム）の閉鎖性（認知上の開放性=学習能力と作動上の閉鎖性）である。尾高によれば実定法の秩序（法システム）が閉鎖し、それ自体の基礎をシステム内部にもつことはけっしてできないから、実定法秩序の基礎を与えるなんらかの規範が必要であり、これを彼は「民衆」の日常生活における事実の規範的な力に求めた。戦後には彼はこれを「ノモス」と呼ぶ。しかしこの民衆（the people）とは当時の文脈では大日本帝国の天皇と臣民に他ならず、法の外部になんらかの規範と法制定権力を求める点でカール・シュミットに近づいていくことになる。 この種のリベラリズムに対する批判はその後、90年代のリベラル＝コミュニタリアン論争でふたたび復活してくることになる。 In the previous academic year, I analyzed legal academic journals, such as Kokka gakkai zasshi (The Journal of the Association of Political and Social Science) and Hôgaku kyôkai zasshi (Journal of the Jurisprudence Association) from the 1930s, as well as works by Tomoo Otaka. In the Japanese academic world of jurisprudence, theories of law positivism, including the pure theory of law à la Hans Kelsen, were sharply criticized almost as soon as they were received. Increasingly though, political and sociological theories of law have been inquired about and accepted. Even though the supposed failure of the pure theory of law came mostly from its misunderstanding or misreading, this corresponded with the supposed collapse of liberalism and its notion of a liberal justice state. This is because the pure theory of law is the most modern and refined project to give a theoretical foundation to universal liberalism and the liberal justice state. Otaka's works can be understood as sociological and phenomenological critiques of Kelsen's legal theory. According to Otaka, a positive legal order can be neither accounted for nor reproduced inside itself, and it always needs an external fundament. He searched for something outside the positive legal order with the help of phenomenology. This was his starting point for his sociological theory of the state. In modern terms, it is concerned with the self-closure—the cognitive openness and operative closeness— of the modern legal system. Because the legal order (legal system) cannot be closed, in his view, the basic norm that gave the fundament to the modern positive legal order is nothing but the normative power of facts (Nomos) that the daily life of the people—in his context, it implied the emperor and subjects of the Great Japanese Empire—represents. At this point, he came closer to Carl Schmitt, who looked for fundamental norms and legislative power outside of the positive legal order. This kind of criticism contra to liberalism was revived in the liberal–communitarian debates of the 1990s.
