成年後見人に法律の専門家が選任されるケースが増加するにつれ、成年被後見人死亡による成年後見終了後の財産管理をいかにおこなうかが問題となっている。成年被後見人の死亡により、成年後見は終了し、後見人には財産管理の権限も義務もなくなる。しかし、財産はなお成年後見人の手元に残ることから、相続人の遺産管理との抵触が生じる。本研究では、フランス相続法の中に、相続人の権限や遺産分割の規律と抵触しない分野を見いだし、死後の事務の法的理論化への示唆を得た。
As a lot of legal professions are appointed to be a guardian, the administration of property after death of an adult ward is turned into legal issue. The office of a guardian comes to an end when an adult ward died, and the pressing necessary business after death of a ward make legal conflicts between guardian and heirs who are entitled to administrate inherited property. This research found out in French succession law the field where there is not the above conflicts and the theory which makes possible of the continued administration by guardian.
