家族間の権利義務関係を遺産分割において考慮するための理論を検討した。例えば葬式費用については、わが国では家族がこれを負担することとなっているところ、フランス法においては、「相続財産の負担」概念により、遺産分割に組み込まれていることを明らかにした。生存配偶者の居住環境の保護についても検討した。フランス法は、その処理方法として、約定夫婦財産制、夫婦間での特殊な贈与契約、長期居住権、遺産分割での居所の優先分与などの選択肢を整備しており、これによって当事者に選択の自由を与えつつ、その居住環境の確実な保護を実現している。
This research aims to build theory to consider family-member-obligations at estate division. Whereas in Japan funeral expenses could be imposed on decedent’s family, in French law traditional concept “charges de la succession” contains theory to make an estate division after funeral expenses.And this research aims to examine system to protect surviving spouse’s habitat. French law has a variety of solutions : Marital property arrangements, special donation, life right of residence, preferential settlement, and so on. It permits surviving spouse to choice optimum way, and at the same time, protects his/her habitat under any circumstances.
