Note (General): 日本の「略奪廉売系差別対価」（以下「差別対価」という）においては、当該商品又は役務（以下「商品」という）のコストを上回る対価が設定された場合、諸状況を総合的に勘案して商品の対価が当該商品にかかったコストを下回らなくても違反となることがあるという、不当廉売に対して差別対価の「独自性」を主張する「コスト割れ不要説」と、商品の対価が当該商品にかかったコストを下回り且つ他の違反要件を満たしたときに違反となって、不当廉売に対する差別対価の「独自性」を否定する「コスト割れ要件説」に分かれている。韓国の差別対価においても、コスト割れ要件説と不要説に分かれており、統一はなされていない。
First-degree price discrimination in Japanese antitrust law,there are two opinions.One is that below some kind of cost(it needed to make goods),it will be illegal(of course, it fulfill other requirements). The other is that sometimes it will be illegal although above some kind of cost.In Korean antitrust law, there are two opinions and not general agreement.
