人格権の準拠法について、実質法上の理解も参照しながら、処分可能性を中心とする権利自体の問題と侵害問題それぞれについて検討した。人格権の性質に鑑みれば、権利自体の準拠法は一義的には属人法となると考えられる（ただし、属人法それ自体の決定方法についてはさらなる検討の余地が残る）。侵害問題は、従来は妥当していた伝統的議論が、インターネットなど新たな技術・状況の出現により妥当しない場面が多くみられるようになっている。その対応のための方策として、外国法との比較を通し、態様により侵害を分類し適用条項を区別するという現行法の解釈の可能性を指摘した。
This study aims to analyze the law applicable to personality rights, specifically the question of the disposability and of infringement, standing also on the analysis of the personality rights at substantial law level. The lex personalis should be applied to the questions of the right itself, ownership, disposability and so forth. The traditional theory for the question of the infringement shows however its limits because of the change of society and the appearance and development of new technologies such as internet. The connecting factor of the habitual residence, which the actual provision applies is not always the most closest. To deal with this situation, this study has tackled with the comparative analysis of foreign legislation and shown the possibility of the interpretation of the actual provision to distinct the cases according to the type of infringement.
