伝統的な警察法理論の理解によれば、通常、具体的危険に対しては個別的措置で、抽象的危険に対しては法令で対処すると理解されている。しかし抽象的危険は、それが具体的危険ではないという理由からしばしば非危険とみなされ、「法令を通じた危険防御」に十分な注意が払われてきたとは言えなかった。本研究は、抽象的危険の概念内容を明らかにするとともに、裁量過程統制論を立法過程に適用することを通じて、実効的な危険防御の全体像を示した。
According to the traditional police law theory the police takes an individual measure against a concrete danger and a legislative measure against an abstract danger. But in the Japanese legal practice an abstract danger doesn't play an important role. This research tries to explicate the abstract danger concept, establisch the criteria for the control of a legislative discretion and explain the judicial system of the effektive danger defence.
