本研究は、「危険防御から危険配慮へ」という危険防御の法システムの転換が指摘されている現状に鑑み、危険の評価をめぐって生じる自由と安全の緊張関係を、危険概念の徹底した法実証化を試みることによって解消し、もって行政機関の適切かつ統制のとれた危険防御権限の行使を探るものである。この研究によって、危険の存否を、行政機関の主観的な判断に基づいてではなく、事実の選択方法、選択時点、また結論の導き方(推論の仕方)に関す客観的な準則に基づいて認定する「危険判断の論証モデル」を提示することに成功した。
