平成18年7月よりオーストラリア現地調査を行った。詳細は、以下の通り。1.訪問・滞在先及び調査対象(1)クイーンズランド大学(クイーンズランド州)ブラッド・シャーマン教授(オーストラリア農業知的財産研究所所長兼務)ロバート・バレル助教授(2)グリフィス大学(クイーンズランド州)リアン・ワイズマン助教授(3)シドニー工科大(サウス・ウェールズ州)フィリップ・グリフィス教授(同教授に対するヒアリングは日本で行った。)2.調査内容(1)オーストラリア薬事法の改正後の状況について米豪FTAにより、薬事法が改正された。これにより、これまでよりも、先発品メーカーに有利な制度に変わりつつある。ただし、治験それ自体の問題よりも治験データの取り扱い方法の問題がより重要である。改正後の影響について前年に引き続き最近の状況について調査した。(2)米豪FTAによる知的財産分や全体への影響について米豪FTAにより、知的財産法の各分野に影響した点を調査し、医薬品特許分やとの影響度合いを比較調査した。(3)オーストラリア国内製薬産業について現状では、後発品メーカーが大部分を占めている。ただし、バイオベンチャーのような特化した分野において、研究・開発型のメーカーが発展しつつある。同分野については、FTA締結による影響を計測することが困難であるが、関係者の見解を調査した。
