Note (General): ドイツ連邦憲法裁判所2005年7月27日判決（BVerfGE 113,348）によって、ニーダーザクセン州の「公の安全と秩序に関する法律」の諸規定（遠隔通信の監視によるデータ収集）が違憲・無効と判断された。これに対する同州の対応について、クリスティアン・シュタルクの論文に即して検討する。その論文では、法改定の2つの主要目的の達成が評価される。特別重大な犯罪行為（テロ行為等）に対する予防的危険防禦（安全の確保）措置と基本権（自由）の保障との間のバランスを、憲法上・法律上どのようにとるか、また、とれるのか、憲法学における深刻な課題がある。
