Note (General): 2007年に著者がワシントン大学にて聴講したJ.K.Winn教授の契約法授業の紹介である。学生には毎回判例報告が義務づけられ、その論理性と適用される法原則の説明が求められていた。一見単純な作業のようにしか思われないが、学生にとっては法の適用の実体的側面を、たとえ机上であっても体験させられ、達成感を伴うものである。その結果、学生達は契約法への理解と関心を深め、非常にinspiringな授業で、学修成果が大きい。実践的に取り入れたい方法ではあるが、学生の基礎的理解が前提となることに鑑みると、学部教育の実状ではハードルが高いものとも考えられる。
