裁判例 当該発明の発明者(原告)でありながら、出願人(被告)が特許出願の願書にその発明者の氏名を記載しなかった為に、特許公報にその氏名が掲載されない場合において、被告に対し願書の発明者の記載を原告である旨の補正手続きを求め、かつ、被告と第三者法人との共同出資会社の取締役である原告が、被告に対し法35条3項の類推適用により「相当の対価」を請求し、それらが容認された事例(大阪地方裁判所平成14.5.23判決)
