1.会社員が少年グループに,監禁,拉致,リンチされて殺害された事案について,警察の捜査等に不手際があったとして,遺族の[栃木]県に対する国家賠償請求が認められた事例 2.捜査上の過失と犯罪の結果との間の相当因果関係を否定したが,当該過失がなければ3割程度の犯罪の結果回避可能性があったとして,この可能性の侵害による損害賠償が肯定された事例[東京高裁平成19.3.28判決]
