Note (General): Fisher, Ury & Patton の Getting To Yes で展開された原則立脚型交渉方法は、交渉の7要素からなる、「実務家のための理論(theory for practitioners)」を生み出した。しかし、つぎのような検討すべき点があると思われる。第1に、7要素間の相互関係が論者によって異なっている。各要素の理論的裏付けをし、ケースや実例によって説明することで、要素間の相互関係を明らかにすべきである。第2に、5つの核心的な（対人的）欲求の意味および核心的欲求と当事者の利害との関係がはっきりしない。精神的損害や慰謝料が発生すべき場合など、実例に基づいた分析が必要だと思われる。第3に、交渉の要素としてのコミットメントが2 つの異なる意味で使われている。1つは、ゲーム理論で言う一方当事者の確実な約束、もう１つは、当事者双方による合意という意味である。もちろん、よい交渉実践にはこれらコミットメントの2 つの側面が必要なことは言うまでもないが、交渉の学習者に対してはこれら2つの意味を区別できるように注意を促すべきだろう。
