Note (General): 金沢大学人間社会研究域法学系
従来,憲法学の研究が手薄だった「人身の自由」を原理的観点から再構成することを目指し,(1)憲法18条論,(2)憲法31条論,(3)裁判員制度の合憲性の再検証をそれぞれ行った。その結果,(1)については,「意に反する苦役」(憲法18条後段)は社会通念上耐えがたい苦痛を伴う労役であること,(2)については,憲法31条を憲法32条とともに,民刑事手続の総則的規定であること,(3)については,共和主義に基づく同制度の正当化は現憲法上不可能であることをそれぞれ明らかにした。
This Research aimed at elucidating 'Freedom of the human body' that the constitutional theory neglects.As a result,it become clear that 'Involuntary servitude' (art.18) is limited to a thing unbearable under normal social conventions,that Art.31 means the basic rule of Legal procedure,that Republicanism cannot justify Lay judge system under present Japanese constitution.
