Note (General)：

日本国憲法36条は、拷問の絶対禁止を規定する。本稿は、憲法上の拷問近視に関する議論が不十分であることを踏まえ、その意義につき検討する。本稿は、国際人権法の議論を参照しつつも、憲法と国際人権法との距離に注意し、特に、拷問禁止の強硬規範としての特徴に注目しながらその憲法上の意義を考察する。
