(不動産所得不動産所得と認めた事例)
1 請求人が不動産業者との間で締結した不動産売買契約は、「土地及び建物」と「賃貸人の地位」について別個に認識し、それら2つの財産を当該不動産売買契約の目的としたとみるのが相当であり、請求人が受領した売買代金の一部は、「賃貸人の地位」の譲渡の対価として受領した金員であると認められ、貸付けに起因する所得であることから不動産所得に該当するとした事例(平成29年分の所得税及び復興特別所得税の更正の請求に対してされた更正をすべき理由がない旨の通知処分・一部取消し・令和3年10月8日裁決)
