歴史
法務局(LS)は、1945年10月2日、GHQ/SCAP の発足とともに設置された(一般命令第10号)。その任務は占領に関わる法律問題及び戦争犯罪に関する政策や手続きについて最高司令官に助言し、また戦争犯罪人の捜査・訴追を指揮することであった。ただし、いわゆるA級戦犯に関する任務は、1945年12月8日の国際検察局(IPS)の発足とともにその所管となった。
よって初期のLS の主な具体的任務は、(1)占領行政に関する法律問題全般、(2)IPSが所管しない戦時国際法及び慣例違反による戦争犯罪(いわゆるBC級戦犯。米軍によるマニラ裁判を担当するマニラ支局もあった。)に関すること(調査、資料の収集、戦争犯罪人及びその容疑者リストの作成・登録、逮捕、軍事委員会若しくは軍事法廷が依るべき法規及び手続きに関する提言等)、(3)軍事占領裁判所が依るべき法規及び手続きに関する提言などであったが、特に戦争犯罪に関係する業務に重点が置かれていた。このほか、豊田副武及び田村浩の裁判(いわゆるGHQ裁判)もLSが担当したが、1949年10月にはアメリカによる審理が終結し、戦争犯罪裁判関係の業務は縮小していった。
その一方、1948年春の組織改編で民政局(GS)から統治機構課と司法課が移管され、司法課は立法・司法課(Legislative and Justice Division)となった。このときGS から異動してきたオプラー(Alfred C. Oppler)が立法・司法課長となった。オプラーはその回顧録(下掲「関連文献」参照)の中で「私達は日本の法律及び司法の監督を担当し、法律課(Law Division)は、それ以外の全ての法律問題、とりわけ日本の立法に関係しない合衆国法及び国際法について連合国最高司令官に助言した。」(原書pp. 221-222、邦訳p. 192)とLS 内での業務の切り分けについて記している。このように占領後半期のLSは、司法行政に対する助言、政治活動や経済活動、国際関係によって生じる法律問題の処理等が業務の中心となった。
